PierPass Fee Increase Delayed The Port Operators for Los Angeles and Long Beach have decided to delay the implementation of a $10 per TEU Pier Pass increase, until August 1, 2011. The announcement can be accessed online at: CBP Provides Guidance on Post-Importation Preference Claims with HTS Changes On June 23, 2011 U.S. Customs and Border Protection published CSMS# 11-000142 seeking to clarify that when a post-importation preference program claim under 19 USC 1520(d) is presented on an entry which also requires a Harmonized Tariff Schedule (HTS) change, the tariff change must be presented separately. According to the CSMS, "Post-importation preference claims allow for a preference claim to be made within one year from the date of importation, if a claim was not made at the time of importation. This statutory provision does not allow for other changes and/or amendments to an entry summary; therefore importers and brokers must use existing regulatory provisions to make corrections to an entry summary." For un-liquidated entries, the tariff change should be presented as a Post Entry Amendment (PEA) simultaneously with the 520(d) submission. US containerized imports growth slows to 5.9pc in May US containerized imports increased 5.9 per cent to 1.5 million TEU in May from a year earlier. Newark's Journal of Commerce staff economist Mario Moreno noted May's growth compared with a nine per cent year to year rise in April, also predicting 4.7 per cent growth for the whole year. During the first five months of the year, imports were up 7.2 per cent. May's import volume was 6.3 per cent ahead of the April volume. Auto parts shipments surged 29 per cent compared to last year as carmakers tried to catch up following disruptions in the wake of the earthquake in Japan in March. China remained the top source of US containerized imports, with a 47.6 per cent share in May. Imports from China rose 3.2 per cent year on year to 716,675 TEU, driven by auto parts and footwear. Imports from Japan grew by 17 per cent to 50,422 TEU, mainly on the back of revived shipments of automotive cargo.
USDA Increases 2011 Sugar Tariff-Rate Quota On June 21, 2011 the U.S. Department of Agriculture (USDA) published a news release announcing it was increasing the fiscal year 2011 raw sugar tariff-rate quota (TRQ) by 120,000 short tons raw value, bringing the total to 1,676,497. Each fiscal year the USDA's Commodity Credit Corporation (CCC) establishes the Overall Allotment Quantity (OAQ) of domestically produced sugar along with the tariff-rate quota level for imports based on expected demand. After its latest review, the CCC determined that additional allotments were needed to ensure adequate supplies and prevent market disruption. As such, the CCC increased the OAQ for sugar and, as this increase was larger than could be fulfilled by domestic cane sugar suppliers, the surplus was reassigned to raw sugar imports as required by law. Sugar entered under this quota can be imported at a reduced duty rate but must be accompanied by a certificate for quota eligibility. Per the news release, "USDA will closely monitor stocks, consumption, imports and all sugar market and program variables on an ongoing basis, and may make further program adjustments during FY 2011 if needed." The TRQ for fiscal year 2012 is expected to be released in the coming months.
