ILA-USMX Negotiation Update

On December 20, 2012, the Journal of Commerce (JOC) issued an update on the negotiations between the International Longshore Association (ILA) and the U.S. Maritime Alliance (USMX), saying that the ILA workers have been advised to prepare for a strike starting December 30, as negotiations stopped on Tuesday.

The article mentions that if a strike occurs once the contract expires on December 29, ILA workers will not process containerized cargo. However, unfrozen perishable shipments, certain containerized military goods, mail, passenger ships, non-containerized shipments and vehicles will be processed.

BIS Amends Export Regulations In Regards To Validated End-Users

On a Federal Register notice filed on December 18, 2012, the Bureau of Industry and Security (BIS) issued a final rule amending the Export Administration Regulations (EAR) by adding the requirement that a written notice must be sent to the recipients of shippers under Authorization Validated End-User (VEU).

The notice explains that "Validated end-users (VEUs) are those entities located in eligible destinations to which eligible items may be exported, re-exported, or transferred (in-country) under a general authorization instead of a license. ... VEUs may obtain eligible items without having to wait for their suppliers to obtain export licenses from BIS."

The notice includes a clarification regarding items subject to item-specific conditions under Authorized VEUs, stating that these items are no longer subject to the conditions associated with these items if they no longer require an export license or they fall under a license exception.

The notice is scheduled to be published on December 19, 2012, and will become effective 30 days after this date.
